Abstract

Artikel ini mengkaji secara kritis urgensi reformasi konstitusi di Indonesia melalui pendekatan penelitian hukum normatif dengan metode studi kepustakaan dan analisis normatif-kualitatif. Penelitian ini menggunakan pendekatan perundang-undangan, konseptual, dan komparatif, dengan membandingkan pengalaman transformative constitutionalism di Afrika Selatan, Bolivia, dan Ekuador. Hasil studi menunjukkan bahwa meskipun konstitusi Indonesia menegaskan keadilan sosial sebagai cita-cita nasional, pengaturannya masih bersifat prosedural normatif sehingga hak-hak sosial-ekonomi hanya bersifat deklaratif tanpa mekanisme penegakan hukum yang efektif. Sebaliknya, Afrika Selatan, Bolivia, dan Ekuador telah berhasil melembagakan hak-hak sosial-ekonomi sebagai hak konstitusional yang justiciable melalui pendekatan konstitusional yang transformatif. Aktualisasi keadilan sosial di Indonesia masih terhambat oleh dominasi oligarki, bias kebijakan neoliberal, lemahnya perlindungan yudisial, ketimpangan regional, rendahnya partisipasi publik, serta fragmentasi kebijakan afirmatif. Artikel ini merekomendasikan reinterpretasi progresif terhadap UUD 1945, penerapan mekanisme constitutional complaint, penguatan penegakan hak sosial-ekonomi, serta reformasi legislasi dan budaya hukum. Pembentukan konstitusi yang transformatif dan hidup menjadi prasyarat bagi terwujudnya keadilan sosial substantif di Indonesia.
